What the law considers unpaid wages

When employees in Tennessee work for an employer, they must be paid. The pay must come on a regular schedule, and in some cases, overtime wages are required. Workers are advised to check their pay stubs and tax documents to ensure that they have received the wages that they are entitled to. There are many ways in which an employer could try to avoid paying an employee.

For instance, an employee may not get paid for all the hours that he or she had worked. It's also possible that an employer fails to pay overtime wages. If an individual does work overtime, it can be a good idea to document those hours. Furthermore, it's wise to keep records related to who authorized the extra hours. As a general rule, workers should first try to work out a problem related to unpaid wages with their employers first.

In some cases, an underpayment could be an honest mistake. If a company is going through bankruptcy, it may be harder for that business to pay its workers in a timely manner. However, if the attempt to underpay a worker was intentional, those impacted can file a claim with the Department of Labor (DOL).

If a worker is not paid a minimum wage for regular or overtime hours worked, it may be a violation of employment law. Legal counsel could review a worker's pay stubs or other information in an effort to determine proper compensation. Through legal action, it may be possible to obtain back pay plus interest along with other damages. If an employer has failed to pay multiple workers, a case may be given class-action status.
